The amendments to New Zealand’s Health and Safety at Work Act shift the primary focus for PCBU duty holders toward managing high-consequence "critical risks"—those likely to cause death, severe injury, or serious illness. For small PCBUs with fewer than 20 workers, duties are streamlined to prioritise these critical risks to reduce compliance burden, while larger businesses must continue managing all risks while prioritising critical ones. Additionally, the updates establish a clear "safe harbour" where complying with an Approved Code of Practice (ACOP) or overlapping legislation (like the Building Act) satisfies HSWA compliance. Finally, officers' due diligence duties are strictly confined to governance functions, separating their oversight responsibilities from operational tasks.
